legally i think you are supposed to delete the roms withing 24 hours of downloading it if you DO NOT own the game, i think they are perfectly legal if you OWN the game,
now im not gonna lie, i have used emulation on a few games, like sieken densetsu 3,(which was not released in the US) and chronotrigger, and maybe a few others.
personally, i dont have a problem with the old systems like genesis, snes, nes, dcast, and ps1, because since those are not as available as newer games, other generations will never experience playing the first mario, etc. with the new stuff, i sorta have a problem like ps2 xbox and gcube....
thats just my 3 cents....

If you own the game and the console (or you cannot reasonably obtain them through resonable methods (in the 50+ provences states) then it's legal.

If this is not the case, then it's violation of US law, and the CAA cannot officially support it.

EDIT: I cannot find legal evidence to backup the claim of legality on the condition that you own the console and the media. For support of the other half, see my post a few posts below.

please don't use capital letters in every word.

if you cannot obtain the ROM in anyway then i believe it's perfectly fine to download a ROM. _BUT_ if it is possible that you can buy the ROM (through anything, including Ebay and offline auctions) then it's illegal. because you can buy it but you didn't.

if any one of Nintendo's people came to my house and asked me to pay for my ROMs then i'll be glad to, because then i'll be owning the ROMs properly. or I spot a ROM on an auction market where i can buy it. too bad i don't yet have a credit card... i could buy so many ROMs properly that way.

yeah, that's my take. but it ain't CAA's take, so don't keep bugging me.

it meant not to quote me directly, as mine is of an idea directly from me, and since you asked specifically on CAA's view of emulated games, it makes sense that i should type that in.

A somewhat official word:

ROMS of anything that you can buy in the United States are completely illegal (with an exception), regardless of if you own the game or not. Furthermore, you shouldn't even have them for 24 hours then delete them.

The exception: really old systems have been declared legal. The NES for example. I'm not sure about the SNES, so I'm steering clear of that.

I had a SNES emulator but when I found out that one of the games I had had been remade for GBA, and that gamespot had given that game a 9/10 as a handheld, I deleted the emulator :P

I have a friend who has a bunch of SNES emulator games, and he says that his dad told him that "as long as you delete it at some point in time it's okay". That sounds logically unsound to me.

Hmm. Perhaps my above post was not completely accurate. Here's the official word on "Subverting access control restrictions to copyrighted material" mentioned in the DMCA.

Pert info follows:

---
"On October 28, 2003, the Librarian of Congress, on the recommendation of the Register of Copyrights, announced the classes of works subject to the exemption from the prohibition against circumvention of technological measures that control access to copyrighted works. The four classes of works exempted are:
...
(3) Computer programs and video games distributed in formats that have become obsolete and which require the original media or hardware as a condition of access. A format shall be considered obsolete if the machine or system necessary to render perceptible a work stored in that format is no longer manufactured or is no longer reasonably available in the commercial marketplace."
...
---

That's the legal wording from the US Copyright Office at:
http://www.copyright.gov/1201/

Emulation is cool. I mentioned this in another thread somewhere, but I can use it to play my original C-64 version of The Traveller's Guide without going through the headache of trying to get it running on the real thing. (Stupid old power connector... *boot* )

If I ever decide to release my disk images of that, you can rest assured that it will be completely legal because it is my own work. (I'll probably make it freeware, too. ^_^ )

It would be interesting to see where this 24 hour rule originated (and how).... it's about the same as saying "So long as you bring the car back before 24 hours, you're only borrowing it, not stealing it."

Personally, the only emulation I do is of old computers and game systems. I also can't lie in saying that I also do NES, SNES, Genesis, emulation etc because nintendo can't make money from those systems anymore except remade ports.

You can also still find the consoles really easily (they even have then on amazon.com: it doesn't get any easier than that). So, it may not still be manufactured, but it is "reasonably available in the commercial marketplace." The games are not hard to locate either, especially if you look on Ebay.

I have used NES, SNES, and Genesis emulators in the past, although I suppose that I probably shouldn't have used the SNES emulator. Oh well...I had some good times playing DBZ hyper dimension (a game which was never realeased in the United States, and thus is not "reasonably available in the commercial marketplace") with my friends.

Theoretically, RAITCM is about as broad as a battleship (and about as grey, too). Here's an interesting question:
* Can you get from a company in the US?

If it wasn't released here, it may be difficult. You could check an import specialist, if there are any around for that good. (Good meaning product.)

The easiest way to see if something can be bought easily is the just try and find it on e-bay. If you can find it there, it's not that tough to get a hold of.

However, INAL so I don't know if it's sound legally.

And even when 2005-2006 hits and PSone is taken off the market, you can always go to GameXchange and grab em...I still find ->NEW<- Dreamcast games at ToysRus.

But I do like the NES/Genesis emulations..hehe

PS1 games tend to be a bit bigger than most people want when downloading roms anyhow... I seriously doubt that running your PS1 games in an emulator that you can run in your PS1 is illegal... The only question is... Why would you want to? There aren't really any good PS1 emulators on PC and I would rather play on my TV and with my PS1 remote than play on the computer with some other controller... I mean, that gets rid of 1 big reason for using consoles in the first place...

NES and SNES, on the other hand, I can understand... The emulators are at the point where in most cases they run BETTER on the computers than on the consoles. Fast forward, save states, cheat searches (can't do that with a NES or SNES game genie) and save game/state sharing. However, some of the NES games and SNES games are still protected by copyright. Mario, final fantasy, Chrono Trigger, Harvest Moon, donkey kong, Ninja Gaiden, Rygar, Street Fighter, all of the disney games (and most movie based games) and this is just a partial list.

That's what Atari did... Well, not burned but buried in the Desert... Quite a few copies of E.T. and I think PacMan. And, I believe they were steamrolled to prevent anyone from pulling them up and playing them... Obsess much?

That reminds me... I still remember Atari's way-too-late attempt at reclaiming their position on the top when NES came around. "No, really, we swear our 2600 is WAY better than the Nintendo... We have hundreds of **coughclonecough** games and now we have a **coughripoffcough** light gun and **coughlamecough** keyboard. We're not drowning and desperate at all!" Atari started and almost ended the video game craze singlehandedly... Thank God for a little playing card company called "Nintendo."

Atari, if the stories on G4tv can be believed, was a product of their own short-sightedness.

They didn't understand that the machine they made would need to be replaced with a better version few years or so down the road.

There where other problems at the time too... Pacman was such a poor recreation of the original game (yet they did other versions years later that where much better, PacMan Jr I think was one. Then the whole ET thing, they pushed it out too fast (so the game wasn't as fully developed as it should have been, not like Indiana Jones) and then they produced more carts than there where systems out there.

I think the 5200 came out in the midst of the video game crash, and the 7800 was a too little, too late project (who's only redeming value was the backward compatability with the 2600) that came out at the point where companies like Nintendo already had people's attention.

One thing about PS1 emulation. Few people would ever bother downloading something the size of a PS1 rom. But most playstation emulators will play the game cds without the system. That's what most people emulate for the PS1. I haven't done anything with it, of course, but friends of mine who do say they work wonderfully.

It requires a massive amount of patch work, as well as a large combination of plug-in files. I suppose that's really all that stops them from being in heavy operation. But when done properly they do work, unfortunately.

I support it. My playstation emulator is working perfectly. epsxe. Yes, you do need a patch in order to play some roms. The plugins are a must. I forgot the site where I got the total package. sorry.

I also have a bunch of roms...

SNES:200+
Genesis:40+
GBC/GB:100+
GBA:90+
PS: I just have the emulaor, and play my PS games on it.
DC: I just have the emulaor, and play my Dreamcast games on it.

LONG LIVE EMULATION!!

Kenchii? We don't support the use of such emulation that is quite obviously in violation of previously mentioned law. At the very least, could you not support it? I'm not going to quibble about Dreamcast or SNES, but the PS1 and GBA are obviously still around...

That's the attitude. Feel free to talk about lower level emulation though, such as NES. Speaking of that, what emulator are your roms for? If it's Nesticle I want them.
